Upon successful completion of 12 months as Assnt Unemployment Insurance Referee, you will automatically advance to Unemp Insur Referee.

Note on Traineeships: When current State employees with prior graded State service transition into traineeships, there will be cases where these individuals will be compensated at a higher rate than the hiring rate of the "equated salary grade" of a traineeship. Specifically, in these cases, the starting compensation of a traineeship will be the higher of either: 1) the hiring rate of the "equated salary grade;" or 2) an employee's current graded salary. For those current State employees with no prior graded service who transition into traineeships, these individuals will be compensated at the hiring rate of the "equated salary grade." Overall, because of the various intricacies associated with the State's salary mechanics, the Office of the State Comptroller should be consulted regarding the actual compensation paid to any State employee transiting to a traineeship.

Summary of Job Description

The Legal Traineeship appointment levels, including the Assistant Unemployment Insurance Referee, leading to the full performance level will require similar duties and responsibilities as stated for the full performance level below (Unemployment Insurance Referee):

As an Unemployment Insurance Referee, you conduct hearings and render decisions in accordance with New York State Unemployment Insurance (UI) Law, related statutes, and special Federal programs, for claimants or employers appealing initial determinations or proposed actions concerning eligibility or employer's liability. You would preside at quasi-judicial or administrative hearings which are of an adversarial or investigative nature concerning the resolution of issues of fact, law, and regulatory practice, directing issuance of subpoenas, requiring attendance of witnesses or the production of necessary documents, taking depositions from witnesses, ruling on the admissibility of evidence, and rendering or recommending decisions.

These positions exist in multiple agencies throughout the State. Assignments will vary, depending on the particular department or agency with which you work.

Summary of Minimum Qualifications

You must take and pass a Civil Service examination in order to be considered for this position.  This examination will be an evaluation of your training and experience.

On or before the date of filing your application you must:

Either 1. Be a graduate of an accredited law school with an LLB or JD degree;

Or 2. Be eligible to take the New York State Bar examination.  You must present proof of eligibility to sit for the New York State Bar exam at the time of interview to be eligible for appointment.
