Summary of Job Description

As a Motor Vehicle Referee in a Traffic Violations Bureau office, you would conduct hearings for the administrative adjudication of moving traffic violations not classified as misdemeanors. You would hear testimony, rule on motions and review evidence and arguments presented. After hearing all the evidence you would make determinations and impose appropriate penalties. You would also determine the advisability of revoking, suspending or restoring driver licenses and/or motor vehicle registrations. As a Motor Vehicle Referee in a Safety Hearings Bureau, you would conduct safety hearings involving fatal accidents, chemical test refusals, "zero tolerance" cases, false statements on Motor Vehicle documents, persistent violators, driving without insurance or other factors which may impact on the driver's ability to safely operate a motor vehicle. You would also conduct hearings involving charges of violations of the Vehicle and Traffic Law and the Commissioner's Regulations by commercial establishments such as repair shops, inspection stations, dealers and other automotive facilities. You would prepare findings of facts and conclusions of law and issue the necessary orders to implement your decisions. Admission to the New York State Bar and current registration to practice in New York State is necessary for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment.

Summary of Minimum Qualifications

You must take and pass a Civil Service examination in order to be considered for this position.

On or before the date of the examination, the candidate must be a graduate of an accredited law school with an LLB or JD degree and/or be eligible to take the New York State Bar examination.
